Violations of Probation
Once you have been placed on probation any allegations of violating a condition of that probation are typically done by way of a petition filed by the Division of Parole and Probation. The matter will eventually come to a hearing where you are facing the possibility of incarceration, a fine, or both. Further, if you were originally granted a probation before judgment, a violation of probation can result in losing the probation before judgment and the entry of a conviction.
There are many possible issues to be raised at violation of probation hearings depending on the nature of the violation. Further, depending on the case, there are things that the probationer should be doing in advance of the hearing in an effort to secure the best possible result.
